NCNY Enterprises Terms and Conditions for Clients

Effective date
November 3, 2026.

These terms and conditions set the rules for the NCNY Enterprises website and for any paid work with our team. We are a US company, and our services cover internships, nearshore hiring and payroll, and support with work visa files. Each service links you with other parties, such as sponsors, host companies, employers and payroll providers in many other countries. These terms explain what we do, how each part of our service works and what we expect from each client. Please read them with care, as they limit our liability and explain how we will settle any dispute between us.

Draft notice: these terms and conditions are a draft, and a lawyer or consultant must review them before launch. Until a lawyer or consultant signs off, they show our plan and not final terms.

Who are we, and how do we work with each client?

NCNY Enterprises is the trade name used by NCNY ENTERPRISES LLC, a New York limited liability company, DOS ID 6600658. That company is based in the US and moves talent across the Americas and Europe. In these terms and conditions, "we", "us" and "our" mean NCNY Enterprises. Likewise, "you" means the person or firm that uses our site or our services.

Also, a "client" is a university, an intern, a business or an employer that asks us to work for it. Each paid service is also covered by a written agreement or an invoice. However, if that written agreement and these terms and conditions differ, the written agreement wins.

You can read our story and our values on the about NCNY Enterprises overview. Next, our US business address will be added before launch.

Which services do we offer, and who are they for?

We offer three services, and these terms and conditions apply to all of them. In addition, each of our services has its own written agreement.

  • International internships: we help students, graduates, professionals and EU universities find host companies in the USA, Canada and Latin America.
  • Nearshore hiring and payroll: we help US firms recruit staff in Latin America and pay them under local law.
  • Work visa support: we handle visa files for employers, and lawyers or consultants who work with us advise and file.

First, our international internship program for universities explains how host matching works. The scope of each service is set in the written agreement. Next, the agreement or invoice lists the tasks, the dates and the fees for your case.

Also, we may change or stop one of our services with fair notice. However, we will finish any work that is already paid for, unless the law stops us.

Who makes the final decision on a placement or a visa?

Under these terms and conditions, each final decision rests with the party that the law names. For example, host companies choose their own interns. Similarly, employers choose their own staff at each stage.

In fact, public bodies grant or refuse visas, and we prepare each file to give it the strongest basis. In the USA, consular officers and USCIS decide on each case. Likewise, Canada and each Latin American country make their own decisions.

Also, we plan with the real processing times of each office and keep you updated. Processing times are set by each office and can change without notice. Therefore, please plan travel and start dates with a safe margin.

Under these terms and conditions, our duty is to do careful work in good faith. As a result, a refusal by a sponsor, an employer or a government is not a breach by us.

How is legal advice given, and who files your visa?

Under these terms and conditions, legal advice and filings come from the immigration lawyers or consultants on your file. In the USA, lawyers or consultants give paid immigration advice. In Canada, paid advice comes from lawyers or consultants.

Who will give advice and who will file the forms?

The lawyers or consultants on your file give all legal advice on your case. For example, an immigration lawyer or consultant advises on the visa route and signs the forms. Likewise, a local lawyer or consultant advises on rules in each Latin American country.

Meanwhile, our team prepares the papers, tracks dates and keeps the file in order. Thus, our team runs the whole service, and the lawyers or consultants give the legal advice within it. Also, you may sign a separate engagement with each lawyer or consultant.

USCIS explains who may give such advice in its guide to legal services (opens in a new tab).

Who decides if an applicant gets a J-1 visa sponsor?

A US internship on a J-1 visa needs a sponsor that the State Department has designated. NCNY Enterprises arranges the DS-2019 with a designated sponsor it works with. In this way, applicants and host companies get the full J-1 step as part of our service.

Therefore, each sponsor makes its own choice to accept or refuse an applicant. It also checks the training plan and issues the papers the applicant needs. Under these terms and conditions, our role is to help the applicant and the host prepare the strongest possible file.

The State Department sets the program rules in its J-1 Intern guide (opens in a new tab).

How do we pay nearshore staff in line with local law?

We help US firms pay nearshore staff in Latin America. Notably, every payment follows the law of the country where the staff member works. Where local law requires it, payments are made through licensed payroll or employer of record partners.

Local payroll runs through our licensed partners in each country, under local law. In fact, our written agreement names the partner that holds each local role. Also, taxes and social charges are paid as local law requires.

These terms and conditions forbid any attempt to avoid tax, currency or labor rules. Hence, we may pause a payment if a document is missing or a rule is unclear. Our nearshore hiring and payroll service describes this process step by step.

What must you do as a client when you work with us?

Overall, our work depends on true and complete facts. So, under these terms and conditions, each client agrees to the duties below.

  • Give us only true, current and complete documents.
  • Tell us at once if a fact changes, such as a date, an address or a job offer.
  • Never send us a fake, altered or borrowed document.
  • Reply to our requests on time so that deadlines are not missed.
  • Obtain consent from any person whose data you send us.
  • Follow the advice of the lawyers or consultants on your case.

Under these terms and conditions, we may stop work at once if a document is false. Also, fees for the work done so far stay due. Indeed, a false document can harm a visa case for years, so we take this rule seriously.

How do our fees work, and when do you pay them?

Our fees are set in a written agreement or in an invoice. Also, this website shows no prices, and each fee is set in a written offer or an invoice. The agreement or invoice states what each fee covers and when it is due.

Your offer or invoice lists every fee, including any sponsor, agency or government fees that we pay on your behalf. In addition, we tell you before any such payment is made.

Next, invoices are due within the time the written agreement states. If a payment is late, we may pause work until it arrives. Finally, refunds, if any, follow the written agreement for your service.

How may you use this website, and what is not allowed?

You may use this website to learn about our services and to contact us. However, you agree not to misuse it in any of the ways below.

  • Do not try to break into the site or its servers.
  • Do not copy the site with bots or scrapers.
  • Do not send false data or another person's data without consent.
  • Do not use the site to send spam or harmful code.

Under these terms and conditions, we may block access if someone breaks these rules. In addition, we may report unlawful acts to the police.

Who owns the text, logos and images on this site?

Under these terms and conditions, we own the text, the logo, the diagrams and the design of this website. You may print or save pages for your own use. Otherwise, you may not copy, sell or reuse our content without written consent.

However, files you send us remain yours. You give us the right to use them only to deliver our services. Names of public bodies or programs are mentioned only to explain the rules.

What limits apply to the content we share on this site?

The content on this website is general guidance, and advice on your case comes from lawyers or consultants. Visa rules, program rules and pay laws change often. Thus, a page may be out of date by the time you read it.

Under these terms and conditions, we provide the site "as is" and "as available". To the extent the law allows, we make no other promises about the site. In particular, we do not promise that it will always work without errors.

Also, links to public sources are given for your convenience. We do not control those sites, and their own terms apply.

How far does our liability to you go under these terms?

Our liability is limited as far as the law allows. Under these terms and conditions, we are not liable for lost profits, lost data or indirect losses. Our total liability for any of our services is capped at the fees you paid for it.

We are not liable for the acts of sponsors, host companies, employers, lawyers or consultants. Each of them is responsible for its own work. Likewise, we are not liable for delays caused by public bodies.

However, these terms and conditions do not limit liability for fraud. They also leave in place any liability that the law does not let us limit. Some places do not allow these limits, so they may not apply to you.

When must you cover the losses that we may suffer?

Under these terms and conditions, you agree to cover our reasonable losses and legal costs in certain cases. These cases are listed below.

  • You gave us a false or altered document.
  • You broke the law or these terms on purpose.
  • You sent us data on another person without the right to do so.

Also, you will be informed promptly about any claim that falls under this section. In return, you may help us defend it with a lawyer or consultant that we both accept.

How do we settle a dispute, and which law applies?

These terms and conditions are governed by the law of [State to be confirmed], USA. A lawyer or consultant will choose the state before launch. Courts in that state will hear any dispute, unless the written agreement says otherwise.

Before any claim, we both agree to try to settle the issue in good faith. First, describe the problem in a message sent through our contact page form. Next, we will reply within thirty days and propose a fix.

Besides, if you live in the EU, you may have rights under your local consumer law. These terms and conditions do not take away rights that the law gives you.

How will we tell you when we change these terms?

We may update these terms and conditions when our services or the law change. Also, the date at the top shows the current version of these terms and conditions. In addition, clients with an agreement or open invoice are told by email before a major change applies.

However, changes do not affect work that is already in progress, unless we both agree. Finally, if you keep using the site after a change, the new version applies to that use.

How do we make this site work for every visitor?

We want every visitor to be able to use this website. Our target is the AAA level of the Web Content Accessibility Guidelines, version 2.2. This is a target, and we have not yet tested every page against it.

The guidelines are published by the W3C in its WCAG 2.2 standard (opens in a new tab). In practice, we aim for strong text contrast, clear focus marks and pages that work with a keyboard.

How can you tell us about a barrier on this site?

If a part of this site is hard to use, please tell us. Report it through the accessibility report form on our contact page, naming the page and the problem. Also, tell us which browser or assistive tool you use.

We aim to reply within five working days. Meanwhile, we can send you the same content in another format, such as plain text.

How can you reach us with a question about these terms?

You can send any question about these terms and conditions through the contact form on our contact page. We answer in English, Spanish or French. Questions on your visa case are best sent to the lawyers or consultants who advise you. Our US business address will be added before launch.

To ask about our services, please use our mobility consultation request form. To see how we treat your data, read our privacy policy for clients as well.
